We do send a contract for each session to be signed electronically. Below is a preview of our contract.
Session Fee/Scheduling/Rescheduling:
Client’s session fee is due in full within 48 hours of receipt of the invoice or the date/time slot will not be held unless the client has made other arrangements with Innovative Photos. Innovative Photos accepts hand-delivered cash (by appointment only), check, or online by credit card via Quickbooks. Session fees hold your session date/time and are non-refundable. Innovative Photos has arranged a "Rain Date" for each Mini Session Date and will work with each client to find the best time. If an illness or situation prevents a photo session from taking place please let your photographer know at least 24 hours before hand, the photographer will do their best to reschedule to another mini session time slot if available. If there are available Mini Session slots you may transfer the payment to that day. If there are no more Mini session slots available you may use the deposit to go toward a full session if schedule permits it.
Innovative Photos will contact the Clients in the event Mini Sessions are rescheduled. Unless a call or message via email or Facebook is received from Innovative Photos, the Clients are expected to retain their original date/time slot.
Mini Session Details/Discount/Late Arrivals:
Mini Sessions are a "special" that Innovative Photos offers to families who do not wish to purchase a full family photography session. Mini sessions are limited to 15-45 minutes per family (depending on the package selected), up to five family members. Innovative Photos will use this time wisely and try to capture the best possible images in the allowable timeframe. This will include entire family images, images of siblings together, and images of children individually, as long as time allows and children are willing to be photographed. Innovative Photos does not work from any sort of shot list so if there is a family combination the client is looking to capture, it is the clients’ responsibility to inform the photographer within my allotted time. As Mini Sessions and their inclusions are offered at a discounted rate, no other offers or discounts apply, and re-shoots are not offered. Because Mini Sessions are scheduled back-to-back, any Client that is late to their session, will lose that time from their session. To avoid this, Clients should intend to arrive at least 5 minutes prior to their session start time.
Children:
It is the Client's responsibility that any children involved in the photography session arrive in the following condition:1. Healthy (Free of illness)2. Full belly (Hunger = unhappy children!)3. Well rested (Fatigue = unhappy children!)4. Clean (Face, clothing, etc.)This is especially important as it pertains to mini sessions, because our time is limited. Please do not allow children to have gum during our session, though tic tacs are fine!
Retouching:
It is Innovative Photos’s policy to not remove any permanent scars or birth marks unless directed to do so by the Client.Basic Portrait Editing (backdrop retouching, blemish/scratch retouching) is included on the ten images that are included with the Mini Session fee. Extensive editing is available for purchase at a price of $15.00 per image at the Client’s request. This includes, but is not limited to: Braces removal, teeth whitening, eye retouching, stray hair removal, excessive tan line removal, and subtle face or body slimming.
Gallery/Inclusions/Portrait Orders:
An online gallery of 10-40 images (dependent upon the session) will be posted within 2 weeks of the Client's Mini Session date. The Client will then be responsible for selecting a set number of favorites, dependent upon the package, for download. The images will be uploaded to an online gallery, password-protected for downloading. The Client will have a 21-day window in which they are responsible for downloading the images to a personal device for printing later. If the Client requests the gallery to be re-posted, a $10 re-posting fee will be issued and the gallery will be reposted for an additional 2-week period.The Client is under NO further obligation to place an order with Innovative Photos. However, the Client may choose to place a portrait or product order from their gallery in the 21-day window.
Copyright/Digital images/Social Media:
The Client's Mini Session includes five, ten, twelve or fifteen digital images (dependent upon package), which will be instantly downloadable and full resolution. A print release will be issued for ease of printing at a lab of their choice. The Client agrees to the reproduction terms outlined in this document and agrees to follow terms of the print release. ONLY the Client(s) named on the print release are authorized to download and print images from their gallery.
Liability
Innovative Photos would never put a Client in danger of any way. However, Innovative Photos shall not be held responsible for any injuries obtained by any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.
Model Release
In exchange for consideration received, the undersigned hereby give permission to Chaunte Johnson, Innovative Photos, for the unrestricted use of their names and photographic likeness, as well as any and all photographic images of their session created by Chaunte Johnson, Innovative Photos, in all forms and media for advertising, marketing, trade, and any other lawful purpose. Permission is granted for images to be combined with other images, text, and graphics, and cropped, altered, or modified. Client(s) and/or parent/guardian further forever release Chaunte Johnson, Innovative Photos, from any and all claims or actions arising out of or in conjunction with the use of said images. Client hereby gives to Innovative Photos the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of the Client and/or minor child in which he/she may be included with others:
I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy. I understand that by entering this contract with Innovative Photos, I am allowing permission for my images to be used for advertising purposes, including Facebook, the Innovative Photos website/blog, and marketing fliers/business cards.
COVID-19 WAIVER
Due to the 2019-2020 outbreak of the novel Coronavirus (COVID-19), an extremely contagious virus that is believed to spread from person-to-person contact, As a result, federal, state, and local governments are recommending social distancing and preventative measures. Innovative Photos is taking extra precautions with the care of every client to include health history review and enhanced sanitation/disinfection procedures in accordance with federal and state health safety guidance. Symptoms of COVID-19 include:

____ I understand that should I have been diagnosed with COVID-19, positive within 14 days before or after my session, I will let Innovative Photos know of my positive diagnosis.
____ I further acknowledge that I have had not had COVID-19 testing with the last 3-7 days before my session, in which I am still waiting on said results.
____ I understand that Innovative Photos has the right to reschedule or cancel my session at any time due to COVID-19 implemented regulations, health concerns, possible exposure, arising symptoms.
____ I understand that Innovative Photos cannot be held liable for any exposure to the COVID-19 virus caused by misinformation on this form or the health history provided by each client. Innovative Photos is following these enhanced procedures to prevent the spread of COVID-19.
By signing below, I agree to each statement above and release Innovative Photos from any and all liability for the unintentional exposure or harm due to COVID-19. I understand the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 and accept sole responsibility for any injury to myself (including, but not limited to personal injury, disability, and death), illness damage, loss, claim, liability, or expense of any kind that I may experience in connection with my photo session.
I hereby release, covenant not to sue, discharge, and hold harmless Innovative Photos, its employees, agents, representatives, and independent contractors, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Innovative Photos, its employees, agents, representatives and independent contractors, whether a COVID-19 infection occurs before, during, or after participation in the photo session. Chaunte Johnson agrees to abide by these standards and affirms the same.
